Terms of service

These terms govern VideoMason, a service operated by TiG Talents in Germany UG (haftungsbeschränkt). By creating an account or using the service, you agree to these terms.

Provider and contract partner

Eligibility, accounts, and access

You must be legally able to enter into this agreement. If you use VideoMason for an organisation, you confirm that you may bind it. You must provide accurate information, keep credentials confidential, and promptly report suspected compromise. You are responsible for activity under your account unless caused by us.

Your content and permissions

You retain ownership of content you upload. You grant us a non-exclusive, worldwide, limited licence to host, copy, process, display, and transform that content only as needed to operate VideoMason, provide support, protect the service, and generate the output you request. The licence ends when the content is deleted, subject to protected backups and legal retention duties.

You confirm that you have the rights, licences, consents, and permissions needed for your content, including any music, images, trademarks, personal data, voices, and likenesses. You must not upload confidential information unless you are authorised to process it through the service.

Generated output

Subject to third-party rights and applicable law, you may use the output generated for you, including commercially. You are responsible for reviewing scripts, facts, figures, likenesses, music, and other output before publishing. Templates and automated assistance do not guarantee accuracy, originality, regulatory compliance, platform monetisation, or audience performance.

Plans, payment, and renewal

Current features, usage allowances, billing interval, currency, taxes, and price are shown before purchase. Paid subscriptions are processed by Polar and renew for the interval shown at checkout until cancelled. You authorise Polar to charge the selected payment method for each renewal. If a payment fails or a subscription ends, paid features may be limited after any applicable grace period.

You can cancel through the customer portal in your Account page. Cancellation stops future renewals and normally takes effect at the end of the current paid period. Unless the checkout terms say otherwise, fees already paid are not refunded for a partial period, except where mandatory law requires a refund. Statutory consumer rights, including any applicable withdrawal right, remain unaffected.

Service limits and changes

Storage, renders, export retention, file size, scheduling, and rate limits depend on your plan. VideoMason may queue, reject, or stop work that exceeds a limit or threatens security or reliability. We may improve, replace, or discontinue features. If a change materially reduces a paid plan during its current term, we will provide the remedy required by applicable law.

Acceptable use

You must follow the Acceptable Use Policy. In particular, you may not misuse accounts, evade limits, attack the service, upload unlawful or infringing content, impersonate others, or create deceptive or harmful media. We may investigate reports and restrict content or access while doing so.

Availability and support

We aim to provide a reliable service, but uninterrupted or error-free operation is not guaranteed. Maintenance, supplier outages, internet failures, and events outside reasonable control may affect availability. Unless a separate written service-level agreement says otherwise, support is provided on a commercially reasonable basis through the contact above.

Suspension and termination

You may stop using the service, cancel a paid plan, and delete workspace data at any time. We may suspend or terminate access for material breach, unlawful or harmful use, security risk, non-payment, or a binding legal request. Where appropriate, we will give notice and an opportunity to remedy the issue. We may act immediately when necessary to protect users, third parties, or the service.

Liability

We are liable without limitation for intent and gross negligence; injury to life, body, or health; fraudulently concealed defects; guarantees we expressly give; and liability that cannot legally be excluded, including under the German Product Liability Act.

For ordinary negligence, we are liable only for breach of an essential contractual duty whose performance is necessary for the agreement and on which you can normally rely. In that case, liability is limited to the foreseeable loss typical for this agreement. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law. The same limits apply to our employees, representatives, and agents. Mandatory consumer rights remain unaffected.

Changes to these terms

We may update these terms for legal, security, or product reasons. Material changes will be communicated in advance where required and will not apply retroactively. If your consent is required by law, we will ask for it. The date above identifies the current version.

Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not remove mandatory protections provided by the law of your country of habitual residence. If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Frankfurt am Main, Germany. Mandatory statutory venues remain unaffected.
